This text aims at pointing out some of the philosophy of law present in the works of the Hellenist philosopher and physician Sextus Empiricus (ΣΕΞΤΟϒ ΕΜΠΕΙΡΙΚΟϒ), and supports two main theses: the first, based on an epistemological point of view, presupposes that exact knowledge of the world — that is, an entirely adequate relationship between the mind of each human being and the events around — is not possible, which insurmountably renders all perception relative. The second thesis, from an axiological (...) point of view, postulates that Skepticism does not necessarily imply disregarding concepts of justice or abandoning any ethical parameters, but functions as an immunizing element against intolerance and dogmatism. This study examines the concept of argumentation empirically, to correct the normative conception of argumentation adopted by most scholars since Aristotle. They are not interested in what argumentation is, but in what it ought to be. The pre-Aristotelian approach is preferable, because it recognizes that argumentation, although it includes persuasion, also embraces other eristic techniques in which the speaker does not necessarily seek to persuade, but simply to prevail. This broader descriptive and pragmatic analysis explains the different ways in which (...) discourse actually occurs and particular arguments succeed, leaving in a secondary place the opinion of each author on how they should be. A Teoria Crítica propõe, com Theodor Adorno, uma íntima relação entre filosofia e desenvolvimento de experiências formativas, constituindo um referencial teórico indispensável para o entendimento acerca do que é pensar filosoficamente em uma perspectiva denominada negativa. Nessa relação, a experiência e racionalidade estética demarcam uma nova forma de conceber a razão e seu momento na relação com a objetividade. Esse momento da razão não indica apropriação, mas remete para uma aproximação e, a partir dessa, a construção de sentido. A problemática (...) que orienta este texto indaga sobre como os conceitos de concreto, aproximação e construção se articulam no desenvolvimento das chamadas experiências formativas. Defendemos a hipótese de que a partir da articulação desses conceitos a riqueza constitutiva da realidade passa a ser manifestada e apreendida, possibilitando, mediante a ampliação das experiências, a manifestação do novo e a construção de sentido. Essa constelação conceitual indica o desafio de considerar a objetividade para além do imediatamente dado; indica, também, o sentido que deve assumir a tensão dialética geradora da aproximação e, por último, um caminho que nos auxilia na tarefa de compreensão do pensamento crítico de Theodor Adorno. Jose Marti contributed greatly to Cuba's struggle for independence from Spain with words as well as revolutionary action. Although he died before the formation of an independent republic, he has since been hailed as a heroic martyr inspiring Cuban republican traditions.

This paper discusses two notational variance views with respect to indexical singular reference and content: the view that certain forms of Millianism are at bottom notational variants of a Fregean theory of reference, the Fregean Notational Variance Claim; and the view that certain forms of Fregeanism are at bottom notational variants of a direct reference theory, the Millian Notational Variance Claim. While the former claim rests on the supposition that a direct reference theory could be easily turned into a particular (...) version of a neo-Fregean one by showing that it is bound to acknowledge certain senselike entities, the latter claim is based upon the supposition that a neo-Fregean theory could be easily turned into a particular version of a Millian one by showing that De Re senses are theoretically superfluous and hence eliminable. The question how many accounts of singular reference and content are we confronted with here — Two different (and mutually antagonistic) theories? Or just two versions of what is in essence the same theory? — is surely of importance to anyone interested in the topic. And this question should be answered by means of a careful assessment of the soundness of each of the above claims. Before trying to adjudicate between the two accounts, one would naturally want to know whether or not there are indeed two substantially disparate accounts. Grosso modo, if the Fregean Claim were sound then we would have a single general conception of singular reference to deal with, viz. Fregeanism; likewise, if the Millian Claim were sound we would be facing a single general conception of singular reference, viz. Millianism. My view is that both the Fregean Notational Variance Claim and its Millian counterpart are wrong, though naturally on different grounds. I have argued elsewhere that the Fregean Notational Variance Claim - considered in its application to the semantics of propositional-attitude reports involving proper names — is unsound. I intend tosupplement in this paper such a result by trying to show that the Millian Claim - taken in its application to the semantics of indexical expressions — should also be rated as incorrect. I focus on a certain set of arguments for the Millian Claim, arguments which I take as adequately representing the general outlook of the Millian theorist with respect to neo-Fregeanism about indexicals and which involve issues about the cognitive significance of sentences containing indexical terms. The COVID-19 pandemic has led to the widespread use of online hearings in arbitral proceedings, raising questions about the impact of such proceedings on the determination of facts underlying a dispute. This article explores the extent to which online hearings may hinder arbitrators’ ability to assess witness credibility by drawing upon the cognitive psychology literature on truthfulness determination and lie detection. A survey of the literature suggests that the ability to differentiate truthful from dishonest statements through verbal and nonverbal cues (...) is limited, leading to the notion that observing behaviors like fidgeting, gaze aversion, vocal pitch, or body posture is not particularly relevant in assessing the credibility of a witness. Instead, focusing on the content of what is reported appears to be the most relevant strategy to determine credibility. Therefore, research does not support the idea that face-to-face contact with witnesses is essential to determine the facts of a dispute. Still, the use of in-person hearings may, in practice, continue to be preferred due to underlying cultural assumptions regarding the nature of hearings, the facilitation of communication between parties, counsel, and the tribunal, and a general sense of _Zoom fatigue_. Depersonalization is characterised by a profound disruption of self-awareness mainly characterised by feelings of disembodiment and subjective emotional numbing.It has been proposed that depersonalization is caused by a fronto-limbic suppressive mechanism – presumably mediated via attention – which manifests subjectively as emotional numbing, and disables the process by which perception and cognition normally become emotionally coloured, giving rise to a subjective feeling of ‘unreality’.Our functional neuroimaging and psychophysiological studies support the above model and indicate that, compared with normal and clinical (...) controls, DPD patients show increased prefrontal activation as well as reduced activation in insula/limbic-related areas to aversive, arousing emotional stimuli.Although a putative inhibitory mechanism on emotional processing might account for the emotional numbing and characteristic perceptual detachment, it is likely, as suggested by some studies, that parietal mechanisms underpin feelings of disembodiment and lack of agency feelings. In the logic of theory change, the standard model is AGM, proposed by Alchourrón et al. (J Symb Log 50:510–530, 1985 ). This paper focuses on the extension of AGM that accounts for contractions of a theory by a set of sentences instead of only by a single sentence. Hansson (Theoria 55:114–132, 1989 ), Fuhrmann and Hansson (J Logic Lang Inf 3:39–74, 1994 ) generalized Partial Meet Contraction to the case of contractions by (possibly non-singleton) sets of sentences. IntroductionThe idea of video recording in the operating room with panoramic cameras and microphones is a new concept that is changing the approach to medical activities in the OR. However, VR in the OR has brought up many concerns regarding patient privacy and has highlighted legal and ethical issues that were never previously exposed.AimTo review the literature concerning these aspects and provide a better ethical and legal understanding of the new challenges concerning VR in the OR.ConclusionsThere is a disparity between (...) the two main legal models concerning VR in the OR, namely the European legal system ) and the American legal framework ). This difference mainly deals with two distinct bioethical paradigms: GDPR places a strong emphasis on protecting patients’ privacy to improve the public health system, whereas HIPAA indicates the need to generate protocols to safeguard the risks connected to medical activity and patient privacy. Following from this point, we may argue that, at the ethical and bioethical level, GDPR and HIPAA depend mainly on two different ethical models: a perspective based on moral acquaintances and weak proceduralism, respectively. It is worth noting the importance of developing additional guidelines concerning different world regions to avoid the ethical problems that may emerge when simply applying a foreign paradigm to a very different culture. In this paper, we intend to discuss how, according to Peirce’s semiotics, gestures can be conceptualized and described as diagrams. We are not concerned with answering when, why or how gestures emerged as semiotic motor activities. As a prerequisite for the very formulation of these problems, we are rather interested in discussing the theoretical conditions which should be fulflled for gestures to be characterized as iconic processes - and more specifcally as diagrammatic processes. The frst step is to summarize a (...) systematic analysis of the variety of iconic signs, elaborated by Peirce, followed by his typology of hypoicons in order to describe the hypoiconic class of diagrams. After that, we present some tentative answers to the question of how to describe gestures as diagrammatic signs. (shrink)

Cause-related marketing has risen to become a popular strategy to increase business value through profit-motivated giving. Despite the growing number of articles published in the last decade, no comprehensive analysis of the most discussed constructs of cause-related marketing is available. This paper uses an advanced Text Mining methodology to conduct a comprehensive analysis of 246 articles published in 40 different journals between 1988 and 2013 on the subject of cause-related marketing. Text Mining also allows quantitative analyses to be performed on (...) the literature. For instance, it is shown that the most prominent long-term topics discussed since 1988 on the subject are “brand-cause fit”, “law and Ethics”, and “corporate and social identification”, while the most actively discussed topic presently is “sectors raising social taboos and moral debates”. The paper has two goals: first, it introduces the technique of CTM to the Marketing area, illustrating how Text Mining may guide, simplify, and enhance review processes while providing objective building blocks to be used in a review; second, it applies CTM to the C-RM field, uncovering and summarizing the most discussed topics. Mining text, however, is not aimed at replacing all subjective decisions that must be taken as part of literature review methodologies. (shrink)

It is still a matter of controversy whether the Principle of the Common Cause (PCC) can be used as a basis for sound causal inference. It is thus to be expected that its application to quantum mechanics should be a correspondingly controversial issue. Indeed the early 90’s saw a flurry of papers addressing just this issue in connection with the EPR correlations. Yet, that debate does not seem to have caught up with the most recent literature on causal inference generally, (...) which has moved on to consider the virtues of a generalised PCC-inspired condition, the so-called Causal Markov Condition (CMC). In this paper we argue that the CMC is an appropriate benchmark for debating possible causal explanations of the EPR correlations. But we go on to take issue with some pronouncements on EPR by defenders of the CMC. (shrink)

No livro dois da Ética Nicomaqueia, Aristóteles afirma com clareza que a prática reiterada de ações virtuosas leva à constituição de uma determinada disposição de caráter, ou seja, o hábito funcionaria como uma segunda natureza, em função da fixidez e estabilidade da disposição por ele constituída, o que aparentemente impediria qualquer modificação no que concerne ao caráter. O problema é que várias passagens do Corpus Aristotelicum parecem contradizer esta asserção, permitindo uma leitura diferente daquela que sugeriria a ideia do hábito (...) como algo que operasse de modo similar à natureza. Este artigo propõe-se investigar se é possível uma leitura que permita, nas Éticas, bem como em outras obras do Corpus Aristotelicum, a possibilidade da mudança de caráter, da decadência ou da reforma moral, bem como sua implicação na investigação sobre o problema do determinismo e da responsabilidade moral. Con el objetivo de superar la crisis en la que se encuentra la filosofía hoy, se expone de manera sencilla una propuesta de una hermenéutica analógica. Se trata de una teoría de la interpretación que incorpora el concepto de la analogía, noción que evitará caer en la postura unívoca de los positivismos y en la equívoca de los posmodernismos. Esto permitirá salir a terrenos más promisorios y fructíferos para la labor filosófica. Para ello, en primer lugar, se desarrollará la concepción (...) de hermenéutica en general y, en segundo lugar, se expondrá el concepto de analogía, de la que toma su nombre la hermenéutica analógica, a fin de que su concepto sea comprendido más fácil y claramente. Brazil is among the approximately 100 countries that recognize a constitutional right to health that includes access to medicines. All over Brazil, patients are turning to courts to access prescribed medicines. Although lawsuits secure access for thousands of people, at least temporarily, this judicialization of the right to health generates intensely complex sociomedical realities and significant administrative and fiscal challenges that, officials argue, have the potential to widen inequalities in health-care delivery. In this article, we explore how right-to-health litigation became (...) an alternative pathway for Brazilians to access health care, now understood as access to medicines that are either on government lists for pharmaceutical distribution or are only available through the market. Is the judicial system an effective venue to implement socioeconomic rights? Which practices of citizenship and governance are crystallized in these struggles over drug access and administrative accountability? (shrink)
